Ignition Interlock Devices
The penalties for driving under the influence (DUI) typically include jail time, probation, mandatory alcohol counseling, fines, and a driver’s license suspension. In some cases, ignition interlock devices may be ordered by the judge. If you have recently been charged with DUI, it is important to speak with a DUI lawyer right away in order to ensure your rights are upheld.
An ignition interlock device is
basically a breathalyzer machine that is installed on the dashboard of your vehicle. In order to start the car, you must
blow into a tube attached to the device. If your blood alcohol content (BAC) is over a preset limit (typically .02-.04%), the ignition will not start.
Ignition interlock devices are built to detect and resist tampering. In order to ensure a human is blowing into the device, rather than a machine, you may be required to make a humming noise or suck in air while performing the test. Newer tests take pictures of the person who is taking the breathalyzer test.
Some ignition interlock devices require a rolling retest while the vehicle is in motion. This prevents a DUI offender from having a sober friend blow into the device in order to start the vehicle. It also ensures that the driver does not start the car while sober and then start drinking while driving. If you fail a rolling test, the horn will sound and lights will flash until you turn off the ignition.
In most cases, a first-time DUI offender will not be required to have an ignition interlock device installed in his or her vehicle. However, if the offender’s BAC was over a certain level, or the offender caused personal injury or death while under the influence, ignition interlock devices may be ordered.
After conviction, you may be ordered to use an ignition interlock device for up to one year. In some cases, having the device installed is a condition of having your driver’s license reinstated.
An ignition interlock device may be rented from a company that specializes in such devices. The cost of renting a device ranges from $70 to $100 per month, while the installation cost is between $100 and $200. The offender is responsible for all rental as well as maintenance costs.
